Background

We have received a request and petition from the owners of 1A Mirani Court, West Lakes Shore, seeking approval to operate licenced outdoor dining and table service in a portion of Mirani Court Reserve (approximately 64 square metres) in an area adjacent to their cafe.

Community Land Management Plan

Mirani Court Reserve is classified as community land. As defined in the Local Government Act 1999, Council must maintain a Community Land Management Plan (CLMP) for the Reserve that sets out how the Reserve is managed and how it can be used.

The current CLMP does not support licenced outdoor dining activities on the reserve. The current purpose for which the land is held is to provide:

• Publicly accessible connected waterfront open space areas with community facilities for community use and
• Spaces that may be utilised from time to time for complementary business purposes.

The Lease and Licence permissions allows for a licence and/or permit to be issued for activities of a short-term nature.

Proposed Amendments to the Community Land Management Plan

An amended CLMP is proposed that would allow Council to permit licenced outdoor dining on the reserve. Some of the key changes include an amendment to the purpose for which the land is held to provide:

• Publicly accessible connected waterfront open space areas which is predominantly parking and limited community facilities for community use and
• Spaces that may be utilised from time to time for complementary commercial business purposes.

The Lease and Licence permissions allow Council to grant or renew licences over any part or parts of the Reserve.
